WHAT IS MEDIATION?

Mediation is a form of Alternative Dispute Resolution.  In Mediation, a neutral third party,
trained in dispute resolution, helps both sides negotiate a settlement in an informal
setting in order to avoid the costs and uncertainty of litigation.  Mediation is non-binding,
and the parties themselves set the parameters for resolving the disputes. Mediation is
intended to be a fair and efficient process where a neutral mediator can help the parties
to reach a mutually agreeable resolution.

Mediation gives the parties the opportunity to discuss the issues in dispute, to clear up
misunderstandings, to determine underlying interests or concerns, to find areas of
agreement, and then to transform the areas of agreement into a workable resolution.

The parties in a mediation do not have to be represented by attorneys, although they
may choose to hire attorneys to represent them.

ADVANTAGES TO MEDIATION

Save time and money.
You can avoid the costs of legal and court fees and have the
opportunity to resolve the dispute immediately.
Mediation is designed to be fair and equal.  The parties have equal say in the process
and the decision to settle.
Confidential proceeding.  Confidentiality agreements can be signed between the
parties.
Avoids litigation.  Mediation is a non-binding alternative to the public process and
uncertainty of a judicial outcome.
Fosters cooperation and communication.  This is especially important if there will be a
continuing relationship, such as between an employer and employee.
Both parties design the solution.  It is possible to resolve not just the legal dispute, but
also to address all issues important to the parties.
Designed to be a win-win situation for the parties.  Because the parties themselves
have control of the parameters of the mediation, there is a greater likelihood of a
mutually satisfying resolution.
